Investigations & Regulatory Enforcement
Obtained a favorable settlement for small business facing a multi-million dollar fine and revocation of its business license in DCWP enforcement action. Client suffered no license consequences, and received 95% reduction in fine.
Civil & Commercial Litigation
Secured award of over $2.2 million in complex commercial arbitration involving a multitude of legal claims, as well as claims of forgery, requiring expert testimony from a former police handwriting analyst.
In multi-million dollar partnership dispute, defeated multiple motions to remove our client from management responsibilities, and to place the parties’ businesses into receivership.
In disability discrimination action, won summary judgment for public school district, including a decision that remote work was not a reasonable accommodation for an entire class of employees. Based on our deposition of the plaintiff, the court also decided that the plaintiff’s claims of retaliation and failure to offer alternate accommodations were not credible.
Won motion for summary judgment for return of contract deposit for purchase of co-op, plus interest and attorneys fees.
Won motion for partial summary judgment as to liability based on Building Code 3309.4 against contractor and subcontractor for adjacent property owner in multimillion dollar construction project.
Landlord-Tenant Litigation
After trial in Housing Court nonpayment proceeding, secured precedent-setting decision expanding landlord’s ability to recover possession from ERAP-recipients without a written lease to rent-stabilized apartments.
Obtained award of attorney’s fees for improper late discovery in Housing Court succession trial. After cross-examination at trial, the court ruled that the hundreds of pages of late-served documents were either inadmissible or carried no weight.
Won summary judgment in co-op dispute in which the co-op Board claimed to own our client’s unit. After extensive discovery, we proved that the Board concealed dozens of documents establishing our client’s ownership.
Successfully defended victim of AirBnB scam against use and occupancy claim by owner for over $120,000, obtaining dismissal of case against our client.
In breach of lease holdover involving significant damage to a luxury apartment and nuisance behavior, secured stipulation requiring tenant to vacate months prior to end of the lease term, and later a money judgment of over $75,000 for unpaid rent and all of our client’s attorney’s fees.
At trial, successfully proved apartment deregulated on the basis of substantial rehabilitation, awarded judgment of possession and warrant.
Defeated illegal lockout proceeding on the basis that landlord did not have possession of the apartment in light of NYPD seal after death of tenant of record.
After a holdover trial, awarded possession of commercial unit and an $800,000+ monetary judgment where the Court found that occupant forged landlord’s signature on the proffered lease.
Defeated co-op landlord’s spurious claim of futility in failing to mitigate damages pursuant to RPL 227-e, awarded summary judgment on counterclaim for return of security deposit under the General Obligations Law.
Appeals & Administrative Review
Secured overcharge award of over $300,000 for tenant on administrative appeal.
In case of first impression, successfully challenged municipal decision refusing to grant owner of an apartment complex an exemption from rent stabilization. Municipality conceded our position following Article 78 proceeding.
In Article 78 proceeding, obtained voluntary remand of DHCR decision denying owner substantial rehabilitation exemption, based on multiple serious errors by agency.
Obtained Appellate Term reversal of decision staying an eviction pending appeal.
